1. Who we are

The Embodied Coaching Institute ("the Institute", "we", "us") operates the website embodiedcoachinginstitute.com and provides the Women Empowerment Coach Training and Certification ("the Training"). The Institute is a brand of healthcoachFX B.V., a Dutch company registered with the Chamber of Commerce under number 59484071, VAT number NL853517423B01, with its registered address at De Geelgors 60, 5271 LR Sint-Michielsgestel, the Netherlands.

These Terms govern your use of this website. By accessing it, you accept these Terms, our Privacy Policy, our Refund Policy, our Compliments & Complaints Policy, and our Imprint. We may revise these Terms at any time by updating this page; your continued use constitutes acceptance of the changes.

2. Use of this website

This website is provided for non-commercial, personal use: to learn about the Institute, our method, and the Training, and to request our brochure or register for our free class. You agree not to take any action that might compromise the security of the website, render it inaccessible to others, or otherwise cause damage to the website or its content, and not to add to, subtract from, or otherwise modify the content or attempt to access content not intended for you. You may not co-brand or frame this website without our express prior written permission.

Where you are asked to provide registration details, all information you provide must be correct, current, and complete. We reserve the right to refuse, suspend, or terminate access where we believe information provided is inaccurate.

3. Accounts and member access

Any passwords for the online learning environment are for individual use only, and you are responsible for their security. Content in password-restricted areas is for your personal use only and may be stamped with your name, email address, and IP address to ensure and enforce personal use. Misuse of access credentials may lead to revocation of access without prior notice, and the Institute reserves its legal claims.

4. Purchases, payment, and delivery

All transactions are processed via third-party PCI-compliant payment providers; available payment methods are shown at checkout. Prices are stated in euros. Upon purchase you will receive an email with access to your member area and the relevant products. Discount codes and time-limited offers are valid only within their stated window and cannot be applied retroactively or combined unless expressly stated.

5. Refunds

Refunds are governed by our Refund Policy. In summary: due to the limited availability of cohort places, tuition for the Training is non-refundable, and students may be eligible for deferment to a later cohort as set out in the Enrollment Agreement.

6. Enrollment Agreement

Enrolment in the Training is governed by the Enrollment Agreement, which you accept at checkout. It covers eligibility, certification requirements and use of titles, the license to Program materials, payment and refund terms, deferment, attendance, confidentiality and session recordings, complaints, program discontinuation, termination, and the Code of Conduct for Students. If these Terms and the Enrollment Agreement conflict, the Enrollment Agreement prevails for matters concerning your enrolment in the Training.

7. Intellectual property

All content on this website and in our programs, including text, images, the Embodied Transformation Framework, curriculum materials, photography, and graduate stories, is the proprietary information of the Institute or the party that provided it, protected by European and foreign copyright laws. Content may not be copied, distributed, republished, uploaded, posted, or transmitted without our prior written consent, except that you may print a copy solely for your personal use. Our marks and logos may not be used without express written permission.

By purchasing a product or program, you receive a non-exclusive, non-transferable, personal license to use one copy for personal purposes, subject to these Terms and, for the Training, the Enrollment Agreement.

8. Submissions and testimonials

By communicating content to us through this website or our programs, including remarks, suggestions, ideas, or feedback, you grant the Institute a royalty-free, perpetual, worldwide, non-exclusive license to use, reproduce, adapt, publish, and display that content. We will treat any personal information in accordance with our Privacy Policy, and we will not publish personal testimonials for marketing purposes without your separate consent.

9. Third-party links and downloads

This website may link to third-party sites that we do not maintain. Links do not imply endorsement, and we are not responsible for the content, availability, or privacy practices of linked sites; you access them at your own risk. We cannot guarantee that files available for downloading will be free of viruses or other harmful code, and you are responsible for appropriate safeguards on your own devices.

10. Child safety

This website and our programs are intended for adults. We do not knowingly permit children under the age of 13 to register or purchase, and we do not knowingly collect personal information about children under 13 except with verifiable parental consent.

11. Health disclaimer

The Training includes education on women's health, hormones, the nervous system, and embodiment practices. This content is educational and does not constitute medical advice, diagnosis, or treatment, and should not be used as a substitute for professional medical advice. The Institute is not a licensed medical care provider. Always consult your professional healthcare providers before beginning any new practice, and participate in embodiment or movement practices at your own discretion and risk.

12. Graduate stories and no earnings guarantee

Graduate stories and testimonials on this website reflect individual experiences and results. They are not a promise or guarantee of income, clients, or professional outcomes. Your results depend on your background, dedication, and circumstances. The Institute does not provide market research, lead generation, or business referral services.

13. Disclaimer of warranties

This website, its content, and our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Institute disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the website will be uninterrupted, timely, secure, or error-free.

14. Limitation of liability

To the maximum extent permitted by law, the Institute, its subsidiaries, affiliates, licensors, service providers, employees, agents, officers, and directors will not be liable for any incidental, indirect, punitive, consequential, special, or exemplary damages arising from your use of this website or our services. In no event will our collective liability exceed the greater of €100 or the amount you have paid to us for the applicable content, product, or service out of which the liability stems.

15. Indemnity

You agree to indemnify and hold the Institute and its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors harmless from any breach of these Terms by you, including any use of content other than as expressly authorized, and from claims brought by third parties arising out of your use of information accessed from this website.

16. Governing law and jurisdiction

These Terms are governed by and interpreted pursuant to the laws of the Netherlands, notwithstanding any principles of conflicts of law. The courts of Amsterdam, the Netherlands have exclusive jurisdiction over any dispute arising out of these Terms or pertaining to their subject matter. If any part of these Terms is unlawful, void, or unenforceable, that part is severable and does not affect the validity of the remaining provisions.

Under the GDPR you have the right to access, correct, delete, and receive a copy of your personal data, to restrict or object to its processing, and to withdraw consent at any time. Enrollment Agreement

Parties and definitions

This Enrollment Agreement (the "Agreement") is entered into between healthcoachFX B.V., a Dutch company registered with the Chamber of Commerce under number 59484071, VAT number NL853517423B01, with its registered address at De Geelgors 60, 5271 LR Sint-Michielsgestel, the Netherlands, operating under its brand Embodied Coaching Institute (hereafter "ECI" or the "Company"), and the student named at the end of this Agreement (hereafter "you").

The "Program" means the Women Empowerment Coach Training and Certification, a 6-month coach training delivered by ECI.

The Company can be contacted at legal@healthcoachfx.com.

This Agreement applies together with the Company's Terms of Use, Privacy Policy, Refund Policy, and Compliments & Complaints Policy, available on the Company's website. If this Agreement and those documents conflict, this Agreement prevails for matters concerning your enrollment in the Program.

While enrolled in the Program, you agree to comply with the Code of Conduct for Students (Exhibit A).

Live Training Sessions take place twice per month via Zoom over the course of the Program. Attendance is required as set out in the Attendance Policy below.

Certification requirements

Upon acceptance as a candidate and successful completion of the Program, and subject to the terms of this Agreement, you will be certified as a "Certified Women Empowerment Coach" and/or "Certified Embodied Transformation Coach" and licensed to use the Company's trademarks and materials within the guidelines set out below.

Successful completion of the Program requires all of the following:

ICF accreditation

The Program is an ICF-accredited Level 1 coaching education program comprising 70 coach education hours (56 hours of coaching education and 14 hours of resource development). Upon successful completion you receive the Embodied Coaching Institute certificate and the titles "Certified Women Empowerment Coach" and "Certified Embodied Transformation Coach".

Graduates who wish to obtain their own ICF credential (ACC) can use the Program toward their application. In addition to completing the Program, the ICF requires: 100 hours of coaching practice; 10 hours of Mentor Coaching with a PCC-credentialed coach, which is not included in the Program and must be completed separately (the Company offers an optional mentor package, or you may choose a mentor independently); and registration with the ICF and passing the ICF credentialing exam. The ICF credential is awarded by the ICF, not by the Company, and is subject to the ICF's own requirements, application process, and fees, which the ICF may change at any time. The Company does not guarantee that you will obtain an ICF credential.

Subject to the terms of this Agreement, while you are an active student or a graduate in good standing, the Company grants you a non-exclusive, non-transferable right and license to use (but not to sublicense) the Program's designated trademarks, copyrighted materials, and program materials (the "Licensed Marks & Content") and to practice as a WECC and/or ETCC coach. The Company remains unrestricted in its own use and licensing of its marks, content, and programs to others in any location.

You agree that you will:

If you withdraw from the Program before completing it, or are expelled for misconduct, you will immediately stop all use of the Licensed Marks & Content and will no longer be authorized to identify yourself as a WECC or ETCC certified coach or candidate.

IV. Program policies

Payment

Registrations are secured on a first-come, first-served basis and are dependent upon receipt of funds. All payments are in euros (€). Tuition is paid either in full as a one-time payment or through an installment plan as offered at checkout. Payments are processed through Kajabi Payments; available payment methods are shown at checkout.

If an installment payment fails, you will be notified and must resolve the failed payment within 7 days. If the payment remains unresolved, the Company may suspend your access to the Program, including Live Training Sessions and the online learning environment, until the balance is settled. Suspension of access does not cancel your payment obligation: the full remaining tuition remains due. Certification and any certificate of completion will be withheld until all tuition and fees have been paid in full.

Refunds

Due to the limited availability of class spots, the Company does not offer refunds on the Program. Students may be eligible for a deferment under the Deferment Policy below.

Deferment

You may defer your enrollment to a later class start date for health, personal, professional, or other reasons, subject to a deferment fee of €200 and payment of any tuition difference between the original and the new start date. Deferment requests must be made within 2 months after the class has started. You will be required to sign a Deferral Agreement and complete an interview with the Program Director to review your reasons for deferment. The deferment fee and any balance will be applied to your account, and payments will continue to be deducted according to your original payment plan schedule.

Enrollment is non-transferable to another person under any circumstances.

Attendance and illness

To meet the minimum required training hours for certification, you must be present at 10 out of 12 Live Training Sessions. If you have an emergency or become ill and cannot attend a session, contact your pod leader and embodiedcoachinginstitute@gmail.com immediately. You will be expected to complete the session materials, review the session recording, and complete a coaching session outside the live session to make up for the missed session.

Withdrawal and non-completion

Failure to complete all requirements of the Program through lack of communication will suspend your graduation and require an obligatory withdrawal from the Program. If this occurs, or if you have requested a withdrawal and later wish to resume, you will be required to apply again, pay tuition again, and start the Program from the beginning. All prior Live Sessions and assignments will need to be repeated. Withdrawal does not cancel outstanding payment obligations under your payment plan.

V. Program content and materials

Program education and information are intended for a general audience and are not specific advice or counseling tailored to any individual.

All materials, procedures, policies, standards, manuals, and teaching aids made available by the Company or its designated facilitators, oral or written, are for your personal use in connection with the Program only. Program content may not be sold, recorded, shared, taught, given away, or otherwise divulged without the express written consent of the Company.

Handouts and resource tools that have been specifically designated as appropriate for distribution to clients may be used for educational purposes, provided you preserve the Company's trademarks and copyright notices on them.

The information in the Program materials is for educational purposes. If you apply ideas contained in the materials, you take full responsibility for your actions. The Company assumes no responsibility for errors or omissions in Program materials.

VI. Privacy, confidentiality, and recordings

The Company respects your privacy and requires that you respect the privacy of your fellow participants. You agree:

Limits of confidentiality

Confidentiality within the Program has limits. If Company staff, faculty, or fellow students become aware of a risk of serious harm to you or to others, whether in Live Sessions, breakout rooms, community boards, the member area, or any other part of the Program, the Company reserves the right to break confidentiality to the extent necessary to address that risk, including contacting emergency services or other appropriate persons or authorities. Where applicable law imposes reporting duties, those duties apply.

Session recordings

Live Training Sessions are recorded. Recordings are made available to Program participants for learning and make-up purposes and are part of the confidential Program materials: they may not be downloaded, shared, or published. By participating in recorded sessions, you consent to the recording of your image, voice, and contributions and to the recordings being shared with participants of your cohort and Company staff and faculty for these purposes.

Recordings may also be used by the Company as educational material in future cohorts of the Program, for example to demonstrate coaching sessions or teaching content. If a recording contains personal sharing by you that you do not want shown to future cohorts, you may ask the Company at legal@healthcoachfx.com to edit out or not reuse those segments, and the Company will honor such requests. Recordings will not be used for marketing or published publicly without your separate, explicit consent.

Coaching demonstrations are a core teaching method in the Program. If you volunteer to be coached in a demonstration during a Live Training Session or a Practice Pod session, you agree that the demonstration is recorded and may be viewed by participants of your own cohort and of future cohorts as teaching material. Volunteering is always optional, you will be asked to confirm before a demonstration begins, and you may ask the Company to edit out or not reuse the recording afterwards as described above.

Cohort recordings made available for learning and make-up purposes remain accessible to students of that cohort for the lifetime of the Program, that is, for as long as the Company continues to operate and host the Program.

Data protection

The Company processes your personal data in accordance with its Privacy Policy. Questions and requests regarding your personal data can be directed to the contact address named in that policy.

VII. Complaints

The Company is committed to providing a quality service. If you are dissatisfied with any aspect of the Program, you can raise this informally with the Program Director, or submit a formal complaint under the Company's Compliments & Complaints Policy, available on the Company's website. Formal complaints are acknowledged in writing and handled fairly, consistently, and where appropriate confidentially.

VIII. Program discontinuation

The Company intends to deliver the Program as scheduled. In the unlikely event that the Program is discontinued, a cohort is cancelled, or the Company ceases operations, the following applies:

The full terms, including the circumstances covered, the teach-out options that may be offered, student responsibilities, and how refunds are assessed, are set out in the Company's Business Closure and Teach-Out Policy, available on the Company's website. That policy forms part of this Agreement.

IX. Termination

The occurrence of any of the following constitutes an event of default and gives the Company the right to terminate this Agreement:

Upon termination, your license to the Licensed Marks & Content ends immediately, and outstanding payment obligations remain due.

X. Governing law and jurisdiction

Any dispute or claim arising out of or in connection with this Agreement is governed by the laws of the Netherlands. The courts of Amsterdam, the Netherlands, have exclusive jurisdiction.

Nothing in this Agreement makes either party the agent, legal representative, subsidiary, joint venturer, partner, employee, or servant of the other for any purpose.

Both parties agree to act in good faith and use their best efforts to comply with their obligations under this Agreement, and neither party shall directly or indirectly engage in activities that would be detrimental to or interfere with the operation or reputation of the other party.

Acceptance

This Agreement is accepted at checkout: by ticking the acceptance box and completing your enrolment, you confirm that you have read, understood, and agree to this Enrollment Agreement, including Exhibit A. Your acceptance is recorded together with your enrolment. Where the Company separately provides this Agreement for signature, the signed version and the version accepted at checkout have the same force.

Exhibit A: Code of Conduct for Students

I agree to conduct myself in a professional and ethical manner and to observe all rules of online etiquette at all times while enrolled as a student in the Program.

The following behaviors are considered inappropriate and dishonest, and are grounds for dismissal from the Program:

Online learning community etiquette

I agree to conduct myself in a polite, ethical, and professional manner in large and small group discussions. I agree not to personally attack fellow classmates, including through profanity or racial and ethnic slurs, over ideas I disagree with.

I understand that violation of this Code of Conduct is grounds for expulsion from the Program.

Refund Policy

Women Empowerment Coach Training and Certification

Due to the limited availability of cohort places, the Institute does not offer refunds on the Training. All sales are final, and you shall not be entitled to a refund for your purchase, except as provided in the Program Discontinuation provisions of the Enrollment Agreement (for example, where a cohort is cancelled before its start date).

Students may be eligible for a deferment to a later cohort for a deferment fee of €200, requested within 2 months after the cohort has started, as set out in full in the Enrollment Agreement.

Payment plans

If you enrol with an installment plan, you remain responsible for all installments of the full tuition regardless of your participation in or completion of the Training, except as provided in the Deferment Policy and the Program Discontinuation provisions of the Enrollment Agreement.

How refunds are paid

Where a refund is due under the Enrollment Agreement or applicable law, the Institute will refund through the same payment provider you used at purchase.

Compliments & Complaints

Our aim

The Embodied Coaching Institute, a brand of healthcoachFX B.V., is committed to providing a quality service and working in an open and accountable way that builds trust and respect. One of the ways we continue to improve is by listening and responding to the views of our students, clients, and community, and in particular by responding positively to complaints and putting mistakes right.

We aim to ensure that: making a compliment or complaint is as easy as possible; we welcome compliments, feedback, and suggestions; we treat a complaint as a clear expression of dissatisfaction with our service which calls for a prompt response; we deal with it promptly, politely and, when appropriate, confidentially; we respond in the right way, for example with an explanation, an apology where we have got things wrong, or information on action taken; and we learn from complaints and use them to improve our service.

We recognize that many concerns will be raised informally and dealt with quickly. Our aims are to resolve informal concerns quickly, keep matters low-key, and enable mediation between the complainant and the person concerned where appropriate.

Definitions

A compliment is an expression of satisfaction with the standard of service we provide. A complaint is any expression of dissatisfaction, however it is expressed, including face to face, by phone, in writing, by email, or any other method.

Compliments

We are always glad to hear from people who are satisfied with our services. All compliments are recorded and acknowledged, and shared with the relevant team member.

Complaints

The formal complaints procedure is intended to ensure that all complaints are handled fairly, consistently, and wherever possible resolved to the complainant's satisfaction.

Our responsibility is to: acknowledge the formal complaint in writing; respond within a stated period of time; deal reasonably and sensitively with the complaint; and take action where appropriate.

Your responsibility is to: bring the complaint, in writing, to our attention normally within 4 weeks of the issue arising; raise concerns promptly and directly; explain the problem as clearly and fully as possible, including any action taken to date; allow us reasonable time to deal with the matter; and recognize that some circumstances may be beyond our control.

Students of the Training can raise concerns informally with the Program Director at any time, or submit a formal complaint to legal@healthcoachfx.com.

Business Closure & Teach-Out

Purpose

The Embodied Coaching Institute intends to deliver every cohort of the Women Empowerment Coach Training as scheduled. This policy explains what happens in the unlikely event that a cohort is cancelled, the Program is discontinued, or the Company ceases operations, so that students know how their education and payments are protected.

Circumstances covered

Notification

Enrolled students will be notified in writing as soon as reasonably possible, with at least 30 days' notice where circumstances allow.

Cancellation before a cohort starts

If a cohort is cancelled before its start date, you may choose between: (a) a transfer to the next available cohort, with no deferment fee; or (b) a full refund of tuition paid for that cohort, refunded through the payment provider you used at purchase.

Discontinuation during a running cohort: teach-out

If the Program is discontinued while your cohort is running, the Company will make reasonable efforts to provide a teach-out option so you can complete the education you paid for. A teach-out option may include, depending on circumstances: completion of the remaining curriculum by the Company's faculty on an adjusted schedule; delivery of remaining modules through recorded materials combined with live completion sessions; or completion through a partner educational provider of comparable quality and accreditation status.

Where no reasonable teach-out option is available, a pro-rated refund for the undelivered portion of the Program may be offered, assessed against the proportion of Live Training Sessions and curriculum not yet delivered, subject to the Refund Policy and applicable law.

Student responsibilities

To make use of a teach-out option, students are expected to: respond to teach-out communications within the stated timeframe; participate in the offered completion schedule; and complete outstanding assignments as required for certification. Students who decline a reasonable teach-out option are not entitled to a refund for the portion of the Program the teach-out would have delivered, except where applicable law provides otherwise.

Student records

Enrollment, attendance, payment, and completion records are retained for at least five (5) years following closure. You may request documentation of your completed training hours, assignments, and assessments, including for the purpose of evidencing your coach education toward an ICF credential, by contacting legal@healthcoachfx.com.

Certification

Students who have completed all certification requirements before or through a teach-out receive their certificate as normal. Students unable to complete due to discontinuation receive documentation of the training hours completed.
